Welcome to Plantia (hereinafter referred to as "the App"). These Terms of Use ("Terms") govern your access to and use of our iOS application, services, and features operated by the developer ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Description of Services

The App provides AI-powered plant identification, species information, care guides, and plant management tools. The services are provided for personal, non-commercial, and educational/recreational purposes only.

2. Botanical & Safety Disclaimer (Crucial Notice)

IMPORTANT DISCLAIMER:

No Guaranteed Accuracy: Plant identification generated by AI algorithms may not always be 100% accurate. Factors such as camera quality, lighting, angle, and plant condition can affect results.
Toxicity & Edibility Warning: NEVER rely on the App to determine whether a plant, berry, mushroom, or fungus is safe for human or animal consumption, or whether it is toxic, poisonous, or dangerous. Always consult a qualified botanical or medical professional before touching or consuming unfamiliar plants.
No Professional Advice: Content provided in the App does not constitute medical, veterinary, agricultural, or professional advice.

3. In-App Purchases and Subscriptions

The App may offer premium features accessible via auto-renewable subscriptions or one-time purchases ("In-App Purchases").

Payment & Billing: Payment will be charged to your Apple ID Account at confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan (e.g., Weekly, Monthly, or Yearly Premium).
Managing Subscriptions: You can manage or cancel your subscription at any time by going to your Apple ID Account Settings on your iOS device after purchase.
Refunds: All purchases and refunds are processed through Apple's App Store according to Apple's standard refund policy. We do not process direct refunds.

4. User Accounts and Conduct

When using the App, you agree not to:

Upload or submit illegal, harmful, offensive, or inappropriate images or content.
Reverse engineer, decompile, or attempt to extract the source code or AI models of the App.
Use automated means (bots, scrapers) to access or harvest data from our servers.
Misuse the App to disrupt services or violate any applicable laws or regulations.

5. Intellectual Property Rights

All software, visual interfaces, graphics, design, logos, algorithms, database content, and proprietary algorithms within the App are the property of the developer ("we", "us") or its licensors and are protected by copyright, trademark, and intellectual property laws.

By uploading plant photos to the App, you grant us a non-exclusive, worldwide, royalty-free license to process and analyze the images solely for providing and improving the identification service.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OF THE APP, ITS AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNISHABLE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PLANT DAMAGE, POISONING, LOSS OF DATA, OR FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

7. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without prior notice, if you breach any provision of these Terms or engage in conduct that harms the operation of the App or other users.

8. Changes to These Terms

We may update our Terms of Use from time to time. Any changes will be posted on this page with an updated "Effective Date." Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
